RECENT MOTOR BUS SMASH.
DRIVERS ON TRIAL FOR MANSLAUGHTER.
ACCUSED OF NEGLIGENCE.
The foot brake on each of the cars was out of order, and on neither had the handbrake been applied. These were important points of the prosecution story when a charge of manslaughter against two motor-bus drivers, Li Kam and Lo Sang, was heard at the Criminal Sessions before Mr. Justice Gompartz this morning.
The case for the Crown was conducted by the Hon Attorney-General, Mr. J.H.Kemp, K.E. and Mr. Campbell Prosser was for the defence.
The charge of manslaughter varies very much in seriousness and gravity, said Mr. J.H.Kemp in his opening address, but the jury were not concerned with the gravity of this case. They had only to determine whether the prisoners were, by their culpable negligence, responsible for the death of deceased.
A collision occurred, said counsel, on a bridge near Castle Peak at about 2.30 p.m. on April 6th between two buses. The first, No. 1204, driven by Lo Sang, was on its way from Un Long to the “Star” Ferry Whart; the second No. 1314, driven by Li Kam, was on the return journey. It was evident from the effect of the collision that they struck at a fairly high joint speed. The bridge on which the collision occurred was only 13 feet wide and each of the buses was six feet wide. The prosecution submitted that neither of the drivers should have taken the slightest risk of being on the bridge at the same time as another bus. The first bus left Un Long at 2.10 p.m. and it must, therefore, allowing for stops, have travelled at an average speed of 16 miles per hour. This was not excessive. The second bus left Kowloon, according to witnesses at 1.10 p.m.; the distance was 21 miles and that worked out at 16 miles per hour if it did not stop at all and maintained the same pace throughout. It must have been doing about nineteen miles per hour when the bridge was approached. The body of the car was torn off the chassis of No. 1204, the left front wheel was struck off and both buses were wrecked generally. The cars were examined by exports from the Kowloon-Canton Railway and they discovered two important facts – the hand brakes on neither car had been touched and the foot brakes were entirely out of order. Prisoners were negligent in not finding out that their foot brakes were out of order, and if they knew this they were negligent in not having them adjusted. It was the suggestion of the prosecution, concluded counsel, that neither driver had any intention of stopping or slowing down. They hoped to get across safely.
The trial is proceeding.
